Terms and Conditions

Version 2 · Last updated 14 September 2026

1. About these Terms

These Terms and Conditions (“Terms”) govern access to and use of "Traveling Books", available at "https://www.traveling-books.eu/" (“Website”).

The Website is operated by:

"Duilio Devigus"
Email: info@traveling-books.eu
Certified email/PEC: duiliodevigus@legalmail.it

In these Terms, “we”, “us” and “our” refer to the Website operator. “User” or “you” refers to any person accessing or using the Website.

By registering an account or using the Website, you confirm that you have read, understood and accepted these Terms.

2. Eligibility

You may create an account and publish content only if you are at least 18 years old.

By registering, you declare that:

  • you are 18 years of age or older;
  • the information you provide is accurate and complete;
  • you have the legal capacity to accept these Terms.

We may request reasonable evidence of age or identity where necessary. We may suspend or delete an account if we reasonably believe that its owner is under 18 or has provided false information.

3. The service

The Website allows registered Users to create an account and submit, save and publish stories and related material.

The service is currently provided free of charge. Internet connection charges and any other costs incurred when accessing the Website remain the User’s responsibility.

We do not guarantee that every submitted story will be published or remain available indefinitely. We may modify, suspend or discontinue all or part of the service for technical, security, organisational or legal reasons.

If reasonably possible, we will provide advance notice of significant changes affecting Users.

4. Account registration and security

To publish a story, you must create an account and provide the information requested during registration.

You agree to:

  • provide truthful, accurate and up-to-date information;
  • keep your login credentials confidential;
  • use only your own account;
  • notify us promptly at info@traveling-books.eu if you suspect unauthorised access;
  • accept responsibility for activity performed through your account, except where it results from circumstances outside your control.

You must not sell, transfer, lend or make your account available to another person.

We may reject usernames that are misleading, offensive, unlawful or likely to infringe another person’s rights.

5. User stories and copyright ownership

You retain ownership of the copyright and other intellectual property rights you hold in the stories and other content you submit (“User Content”). We do not acquire ownership of your User Content.

By submitting or publishing User Content, you grant us a non-exclusive, worldwide and royalty-free licence to:

  • host, store and reproduce the User Content;
  • publish, display and make it available through the Website;
  • format, resize or technically adapt it as required to operate the Website;
  • promote the User Content and the Website through our newsletters, social-media profiles, promotional materials and other communication channels;
  • use the story’s title, short extracts, cover image and your chosen public author name for those promotional purposes.

This licence is granted for as long as the User Content remains available on the Website and for a reasonable period afterwards for backup, security and administrative purposes.

You may request removal of your published User Content by contacting info@traveling-books.eu

Following removal, we will stop using the complete work in new promotional materials within a reasonable period. Removal may not immediately affect:

  • backup copies retained temporarily for security or technical reasons;
  • content already lawfully shared or reposted by third parties;
  • printed materials or campaigns produced before the removal request;
  • information we must retain to comply with legal obligations or defend legal claims.

Any use of a story outside the licence described above, such as commercial publication in a book, requires the author’s separate permission.

6. Your declarations concerning User Content

By submitting User Content, you declare and guarantee that:

  • you created the content or have all permissions necessary to publish it;
  • its publication and our permitted use will not infringe copyright, trademark, privacy, image, confidentiality or other third-party rights;
  • where the content identifies or depicts another person, you have obtained any legally required permission;
  • the content complies with these Terms and applicable law;
  • the content does not contain confidential information that you are not authorised to disclose.

You remain responsible for your User Content and for the consequences of publishing it.

7. Prohibited content and conduct

You must not publish or use the Website to distribute content that:

  • is unlawful or promotes unlawful activity;
  • infringes copyright or other intellectual property rights;
  • violates another person’s privacy, image rights or confidentiality;
  • is defamatory, threatening, harassing or discriminatory;
  • promotes hatred, violence, terrorism or harm against individuals or groups;
  • contains child sexual abuse material or sexually exploits any person;
  • contains non-consensual intimate material;
  • fraudulently impersonates another person or organisation;
  • contains malware, malicious code, scams, phishing or deceptive links;
  • discloses sensitive personal information about another person without a lawful basis;
  • constitutes spam or unauthorised advertising;
  • has been generated or manipulated in a manner intended to deceive readers about its origin or authenticity.

You must not:

  • interfere with the security or operation of the Website;
  • attempt to obtain unauthorised access to accounts, servers or data;
  • scrape or collect personal data without authorisation;
  • use automated systems in a way that places an unreasonable burden on the Website;
  • manipulate ratings, views, comments or other engagement indicators;
  • evade a suspension, restriction or account ban.

8. Artificial intelligence and third-party material

If User Content was created or materially modified using generative artificial intelligence, you remain responsible for ensuring that it complies with these Terms and applicable law.

Where appropriate, you should clearly disclose that artificial intelligence was used, particularly when the content could reasonably be mistaken for an authentic account of real events.

AI-generated content must not misuse another person’s identity or likeness or unlawfully reproduce protected third-party material.

Quotations, images, music, translations and other third-party material may be included only when you have the necessary rights or when their use is otherwise permitted by law. Attribution alone does not necessarily constitute permission.

9. Content moderation

We may review content using human moderation and, where appropriate, automated tools.

We may refuse publication, limit visibility, add warnings, remove content, restrict Website functionality, suspend an account or terminate an account when we reasonably believe that:

  • the content or conduct violates these Terms;
  • action is necessary to comply with the law or an order from a competent authority;
  • another person’s rights may have been infringed;
  • action is necessary to protect Users, third parties or the security of the Website.

Where required by applicable law, we will provide the affected User with an explanation of the principal reasons for the decision and the available means of appeal.

Moderation decisions may take account of the nature, context, severity and frequency of the violation. We are not required to publish every story submitted to the Website.

10. Reporting illegal or infringing content

Anyone may report content they believe to be illegal or to infringe their rights by using the following contact details:

Email: info@traveling-books.eu
Online reporting form: "https://www.traveling-books.eu/contatti"

A report should include:

  • an explanation of why the content is considered illegal or infringing;
  • the exact URL or other information identifying the content;
  • the reporting person’s name and email address, unless the law permits an anonymous report;
  • a statement confirming that the report is made in good faith and that the information supplied is accurate.

Copyright reports should also identify the protected work, explain the reporting person’s relationship to the rights holder and provide any relevant supporting evidence.

We will assess sufficiently precise and adequately substantiated reports in a timely and impartial manner. We may contact the reporting person or affected User for additional information.

Knowingly submitting false or abusive reports may result in restrictions on use of the Website.

11. Appealing a moderation decision

If your content or account is restricted, you may ask us to review the decision by contacting info@traveling-books.eu within six months of receiving notice of the decision.

Your appeal should identify the decision and explain why you believe it should be changed.

We will review eligible appeals carefully and, where applicable, under the procedures required by the Digital Services Act. You will be informed of the outcome.

Nothing in these Terms limits any right you may have to contact a competent authority, use a certified out-of-court dispute-settlement body or seek judicial redress.

12. Account suspension and termination

You may stop using the Website at any time. You may request deletion of your account through account settings, delete profile or by contacting info@traveling-books.eu.

We may suspend or terminate an account if:

  • the User seriously or repeatedly breaches these Terms;
  • the account is used unlawfully or fraudulently;
  • suspension is necessary to protect the Website, its Users or third parties;
  • we are required to do so by law or by a competent authority.

Except in urgent cases, we will normally inform the User of the reason for the decision and any available review procedure.

Deleting an account does not automatically remove information that we are legally required to retain. Before deleting your account, you should download any content you wish to preserve.

13. Privacy and personal data

We process personal data in accordance with the General Data Protection Regulation (“GDPR”), applicable Italian data-protection law and our Privacy Policy.

The Privacy Policy explains:

  • who the data controller is;
  • which personal data we collect;
  • the purposes and legal bases of processing;
  • how long data is retained;
  • whether data is shared or transferred internationally;
  • Users’ data-protection rights;
  • how to contact the data controller or Data Protection Officer, if appointed;
  • how to lodge a complaint with the Italian Data Protection Authority.

Acceptance of these Terms does not constitute consent to processing activities that legally require separate consent.

14. Website intellectual property

Except for User Content and third-party material, the Website, including its name, logo, design, software, databases and original editorial material, is owned by or licensed to "Duilio Devigus".

You may access and use the Website for personal and lawful purposes. You may not copy, distribute, modify, reverse-engineer or commercially exploit protected elements of the Website without prior permission, except where permitted by mandatory law.

15. Third-party links and services

The Website may contain links to external websites or services. We do not control and are not responsible for their availability, security, content or privacy practices.

The inclusion of a link does not necessarily mean that we approve or endorse the third party concerned.

16. Availability and disclaimers

We aim to keep the Website secure and available, but we cannot guarantee that it will always operate without interruption, delay, errors, data loss or security incidents.

Stories are created by Users. Unless expressly stated otherwise, we do not endorse them and do not guarantee their accuracy, reliability or quality.

Users should keep their own copies of stories and other material submitted to the Website.

Nothing in these Terms excludes guarantees or rights that cannot lawfully be excluded.

17. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for:

  • indirect or consequential losses;
  • loss resulting from a User’s reliance on User Content;
  • content or conduct attributable to another User or third party;
  • disruption caused by events outside our reasonable control;
  • loss of content where the User has failed to retain a backup copy.

These limitations do not apply to liability that cannot be excluded or limited under Italian or European Union law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury where legally applicable.

Nothing in these Terms affects mandatory consumer rights.

18. User responsibility

Where permitted by applicable law, a User who unlawfully publishes content or intentionally breaches these Terms may be responsible for losses, costs or third-party claims directly caused by that conduct.

This provision does not impose liability beyond what is permitted under applicable law and does not limit mandatory consumer protections.

19. Changes to these Terms

We may amend these Terms to reflect:

  • changes to the Website or its functionality;
  • legal or regulatory requirements;
  • security requirements;
  • changes that benefit Users or clarify existing provisions.

We will give Users reasonable notice of material changes by email, through their account or by displaying a notice on the Website, unless an immediate change is required for legal or security reasons.

The notice will state when the revised Terms take effect. If you do not accept a material change, you may stop using the Website and delete your account before it takes effect.

20. Communications

We may send service-related communications concerning your account, security, published content or changes to the service. These are not marketing communications.

Promotional emails will be sent only when there is an appropriate legal basis. You may withdraw marketing consent or unsubscribe at any time.

21. Governing law and jurisdiction

These Terms are governed by Italian law, without prejudice to any mandatory protection granted to consumers under the law of their country of habitual residence.

If you are a consumer, disputes will be subject to the court determined by mandatory consumer-protection rules, including the competent court of your residence or domicile where applicable.

In other cases, the courts of [Italian city] will have exclusive jurisdiction, unless mandatory law provides otherwise.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be interpreted or replaced, where legally possible, in a way that most closely reflects its original lawful purpose.
